1. General Terms and Conditions (GTC) for the use of the Soulary website   Room

1.1 Booking and cancellation

The room reservation is only binding after receipt of the room costs on the specified Soulary account for the booked period.
Cancellations are only possible in writing (by email) and must be confirmed in writing. If canceled up to 14 days before the event date, a 50% cancellation fee will be charged. If you cancel 14 days or less before the start of the event, the entire amount (100%) will be retained. This also applies if you do not show up without canceling in a timely manner. In the case of dunning procedures, additional dunning and processing costs (€7/booked rental package) as well as costs are incurredRubbing fees (€2.70) will be charged. The cancellation fee can be replaced by naming a replacement tenant in consultation with the Soulary team.

1.2 Rules of Use

The house rules, terms of use and general terms and conditions have been read and accepted.
Any irreversible changes to the room are prohibited.
Smoking and bringing animals are strictly prohibited in the room and throughout the entire residential complex.
Street shoes are not allowed in the Soulary Room; Shoes must be taken off in the entrance area.
Soulary assumes no liability for personal items.

1.3 Room handover

The room must be left in a clean and tidy condition after use. In the event of major contamination, a cleaning fee of €40 will be charged.
All utensils used must be returned, technical devices switched off, windows closed and the door locked by pressing the combination lock.

1.4 Responsibility of the tenant

The tenant is liable for all damage caused by him, his agents, customers or participants.
The rental item includes the use of all technical devices, but Soulary does not guarantee their functionality. There will be no reimbursement of costs in the event of technical problems.

1.5 Other provisions

The tenant may not make any commercial use of other parts of the building and may not park vehicles or materials in the courtyard or corridor areas.
Passing on the entry code to third parties is prohibited. The tenant is obliged to lock the room using the NukiPad after leaving.

1.6 Long-term booking discount for the room rental of the Soulary Room

If the room is rented regularly, there is an additional Rabatt of 10%. The use of space is considered regular if                  for at least one quarter (i.e. 3 months) at least one hour every week is booked.

 

2. General

Subject dThese terms and conditions apply to all offers and services from Soulary, regardless of location, time and duration of implementation, providedn nothing different arises from the respective contracts. By using an offer or service, the customer accepts these terms and conditions unconditionally.

Rights of use

All services from Soulary are basically open to anyone interested. However, there is no legal right to use services. If special personal conditions are required for a particular service, these must be met by the customer. Soulary reserves the right to reject interested parties before providing the service without giving reasons or to subsequently terminate the contractual relationship due to non-fulfillment of participation requirements.

FThe following conditions apply to all offers carried out by Soulary:

​Registration
The binding registration for Soulary services must be made in writing by email, to which the customer will receive a confirmation email. The place is then secured and the participation fee is due for payment. Registrations will be considered in the order in which they are received. With the registration confirmation by emailthe contractual relationship is legally valid. If a registration cannot be considered, the interested party will be informed immediately. It Only registrations from adults will be accepted without exception. Minors are represented by their parents.

Payment terms
The participation fee for Soulary seminars/workshops must be transferred before the start of the event. The participation fee is due upon registration and must then be transferred to the bank details provided without delay. Late payment occurs if the claim is not settled within a set deadline. The customer bears the full amount of any processing fees and court reminder fees. In the event of late payment, Soulary is entitled to withdraw from the contract and pass on the course place to other people.

Obligation to participate, exclusion
Participants are encouraged to participate regularly and constructively in the courses (or other booked series of events, such as training courses). Absences or the decision to cancel an offer that has already been booked are, without exception, the responsibility of the participants and do not constitute a right to a refund of participation fees.

Arrive for workshop/seminar/training
Soulary opens 15 minutes before the event begins. We ask that you arrive on time so that the participants who are already present are not disturbed. Access is only possible for all participants until the course begins. There is no entitlement to later access and participation in a unit that is already running.

Cancellation of registration, withdrawal modalities                                                                                                                                                       Cancellations will only be accepted in writing (e-mail).epted and confirmed in writing. If the registration is canceled up to 9 days before the event date, no cancellation fee will be charged. If canceled between 9 and 5 days before the start of the event, a processing fee of 50% of the invoice amount will be charged. In the event of later cancellations (from 5 days before the start of the event), the entire participation fee will be charged. This also applies if the participant simply stays away from the course without deregistering in a timely manner. If it becomes necessary to demand payment of the course fee by means of a reminder, additional reminder or processing costs (€7/booked course) and registration fee (€2.70) will be charged. Cancellation contributions are also requested using a dunning procedure. A replacement participant can be provided at any time and this replaces the cancellation fee.

Implementation of events, cancellation, demolition, changes
In order to maintain a high quality standard for yoga classes, courses, seminars and workshops, the number of participants is limited. The implementation of a course/workshop is tied to the achievement of a minimum number of participants by a specific deadline. If there are fewer registrations, the course/workshop may be changed, postponed or canceled. Participation fees that have already been paid will be refunded in full or, at the customer's request, the booking can be rebooked to another course/workshop. Further claims for damages are excluded. Soulary reserves the right to postpone, interrupt or cancel a course unit or an entire course at short notice for important reasons. In the event of cancellation or postponement, fees already paid will be refunded in full; in the event of an interruption, a pro rata amount will be refunded. If an entire course is affected, a rebooking can optionally be made at the customer's request. A further claim for damages is not justified.Soulary points out that the content and course of courses or the workshop/seminar leader can be changed at short notice if necessary - while fundamentally maintaining the overall character of the course. This does not entitle the participant to withdraw from the contract. A claim for damages is excluded.

Course exclusion                                                                                                                                                                                                           

Soulary keeplt reserves the right to deregister a course participant from the course during an event and to ask them to leave the seminar premises without giving reasons. In this case, the course participation fees will be fully refunded.  

Liabilityg of Soulary
Soulary's liability for personal injury, financial damage and property damage is limited to intent and gross negligence. Soulary is not liable for the consequences of improperly performed exercises. Liability in the event of loss of clothing, valuables or money is also excluded. Use of Soulary's services is at your own risk and risk. Soulary is exempt from any liability claims in this regard and is therefore not liable for accidents or resulting physical damage to customers. By registering, each customer declares bindingly that he/she has a personal Has liability and accident insurance. Soulary disclaims any liability towards customers and third parties. Soulary carries out the individual services professionally and conscientiously in accordance with the principles of proper execution and strives to ensure the accuracy and completeness of the content and the data and information provided as part of its services. However, no guarantee can be given for the topicality, correctness, completeness or quality of the information provided. Liability claims against Soulary that relate to material or immaterial damage caused by the use or non-use of the information provided are generally excluded, unless Soulary can be proven to have acted intentionally or with gross negligence.

Health status of the participants
The participants assure that they are not suffering from a contagious disease and that there are no medical reasons preventing them from performing the exercises. Chronic illnesses, diseases of the musculoskeletal system and other physical or psychological illnesses that could influence the participant in his/her practice are / inform the course instructor before the start of the lesson. Pregnancy must also be announced to the course instructor before the start of the lesson.

​Requirements

By registering, each customer declares that he/she is physically healthy and mentally stable and                can cope with the relevant physical and mental demands. The services offered are not intended as              Therapy or healing program. They in no way replace medical care or medication prescription. In          If in doubt, a doctor should be consulted.

CONFIDENTIALITY, DATA PROTECTION
Personal and company-related customer data is collected, stored and processed in accordance with data protection regulations and is not passed on to third parties. Confidential customer information that becomes known in the course of the collaboration will be treated as strictly confidential.

FINAL PROVISIONS
There are no additional agreements. Changes must be made in writing. This also applies to the written form clause. We reserve the right to correct errors as well as printing and calculation errors. Should individual provisions of the General Terms and Conditions of Business and Participation be or become ineffective in whole or in part, this will not affect the validity of the remaining provisions (severability clause). To the extent legally permissible, another appropriate regulation will apply in place of the wholly or partially ineffective regulation, which comes closest to the original regulation in terms of its economic meaning and purpose.

APPLICABLE LAW AND JURISDICTION
Austrian law applies with the exclusion of its reference norms. For all disputes, the court with jurisdiction for Vienna (1050) has exclusive jurisdiction over the dispute between the parties.
